We can help with family immigration issues regarding the following:
Dependants
The UK Home Office can allow dependent children and other relatives to come to the UK under certain circumstances.
Applications under this category are highly complex due to the high level of evidence required to prove dependency, especially with regards to dependent children over the age of 18 and elderly relatives.
Entry clearance officers have to apply a strict policy in all immigration matters. Discretion can sometimes be exercised on compassionate grounds, but such cases are difficult to prove.
Newland Chase have substantial experience in handling these cases.
Marriage / Civil Partnership
The marriage / civil partnership visa allows individuals to apply to the British Overseas Mission or the UK Border Agency for leave to remain on the basis of their marriage or civil partnership with a British citizen or settled person.
Couples will need to satisfy specific requirements set by the UK government regarding their relationship, funds and accommodation arrangements in the UK. If the application is successful, this category leads to settlement.
Spouses not from an English speaking country will also need demonstrate that they speak a sufficient level of English.
Newland Chase can provide advice and assistance with regards to obtaining a marriage / civil partnership visa and a Certificate of Approval from the Home Office. We can also provide language training to help spouses to prepare for the English language test.
Unmarried Partners
The unmarried partners visa allows individuals to apply to the British overseas mission or UK Border Agency for permission to enter or remain in the UK on the basis of their relationship with a British citizen or settled person.
Couples will need to satisfy specific requirements set by the UK government, including a requirement to demonstrate they have lived together in a relationship akin to marriage for at least the past 2 years, as well their funds and accommodation arrangements in the UK. If the application is successful, this category leads to settlement.
Substantial evidence is required to successfully prove cohabitation, and failure to submit sufficient evidence can result in a refusal. In some circumstances a couple may not be in a position to provide all the evidence required by the UK Border Agency.
Newland Chase can provide advice and assistance with regards to obtaining an unmarried partners visa. We can gather evidence and make representations on your behalf to the UK Border Agency, giving you the best chance of success in your application.
