UK- new policy guidance for applicants requesting a review of a refusal on the grounds on maintenance.

The UK Border Agency has issued new policy guidance for applicants wishing to request a review of their case in the event of a refusal.  This new policy guidance is specific only to applicants who have been refused entry clearance or leave to remain for failing to meet the maintenance (funds) requirement of their points based system application.

 

The Immigration Rules specify that a migrant must have the level of funds required by their tier on the day the application was made.  Under the new review guidelines, if the migrant cannot demonstrate that they held the funds on the day of the application, then the migrant must demonstrate that they held the required level of funds at any one day during the one- month period before the application was submitted.

 

A review can be requested if an entry clearance application was submitted abroad between 23 June and 22 July 2010 or if an application for leave to remain was submitted lawfully from within the UK on and up to the 22 July.  The deadline for requesting a review is the 22 June 2011.
