Which Immigration Category?

The most common visa category for temporary work authorization of foreign nationals in Hong Kong is the Employment Visa.

Business visitors can be granted a Visitor Visa, which is for a foreign national seeking to enter Hong Kong temporarily for permitted business activities.

A) Overview of Employment Visa Applications

1. Employment Visa Application

The Employment Visa application forms with the correct accompanying documents must be filed with the Hong Kong Immigration Department for approval.  Applications for any dependant visas should be filed at the same time.

Processing time is between 4-8 weeks.

2. Visa Approval and Entry Label

Once the employment visa application has been successfully approved, the entry visa label should be collected from the HKID and forwarded to the assignee.  The label is valid for 3 months from the date of issue, and the assignee must attach it to his/her passport before arriving in Hong Kong.

Upon arrival in Hong Kong, the assignee’s visa will be stamped and authorize employment for up to 12 months from the date of entry.

3. Hong Kong Identity Card (HKIC)

Depending on the length of the assignment, the migrant worker may need to apply for a HKIC, which must be applied for within 30 days of arrival in Hong Kong.

What is the duration of an Employment Visa?

The Employment Visa is generally valid for twelve months for the initial Visa, with the potential for indefinite extensions, provided the assignee continues to be employed by the host Hong Kong company.

Dependants

In respect of family members of a foreign national who is granted an Employment Visa, spouses and children under the age of 18 can accompany the principal applicant and dependants may seek employment.  However, requirements vary on a case by case basis, so for more details on whether your family members are eligible for a dependant visa, please contact us.

B) Overview of Business Visitor Visa Applications

Permitted Business activities include:

2) Contract related work
3) Exhibitions or trade fairs

What is the duration of a Visitor Visa?

A Visitor Visa is usually granted to business travellers for up to 6 months, however this is discretionary and can vary depending on your country of origin and the purpose of your visit.
